All injuries and losses are hard to endure, but wrongful death cases are catastrophes. Wrongful death cases are controlled by Virginia Code Section 8.01-50. Claims must be brought by the personal representative of the estate of the deceased. The damages that are permitted are enumerated by statute and include sorrow, mental anguish, loss of expected income, loss of companionship, loss of services, cost of final care and funeral expenses, and other items of loss. The beneficiaries are also limited by statute to certain classes and categories of individuals.
