Drinking and driving is simply a recipe for disaster. When someone gets behind the wheel while drunk and injures another person, in many cases the responsible driver is liable for punitive damages in addition to compensatory damages. Juries and the public usually can be counted on to take a dim view of these cases, and insurance companies often alter their strategies when trying to defend the drunk driver. The plaintiff’s attorney should be alert to these shifts and not be deterred from showing the outrageous nature of the conduct involved.
Special statutes may apply, such as a Virginia statute that equates a particular blood alcohol level with “willful disregard” of someone’s safety such that the drunk driver is liable for punitive damages.
