A large vehicle carrying several tons of cargo can deliver a devastating force to the human body. Tractors, trailers and other large trucks are recognized as being more dangerous than the typical family auto, so a special set of safety regulations often applies to such vehicles. These special rules – if violated – can form the basis of a valid legal claim against the owner or operator of such vehicles. For example, the Federal Motor Carrier Safety Regulations are applicable to commercial vehicles and set out safety rules pertaining to equipment (such as brakes, lights, etc.), maintenance, proper loading techniques and driver qualifications in order to operate a “big rig”. Insurance coverage for tractors and trailers can also present unique challenges and is different than insurance for the typical family auto.
For example, a so-called independent owner/driver will sometimes have the benefit of insurance policies that were written to cover his employer. Trailers can sometimes be covered separately from tractors under insurance policies, which means in some cases we can increase the amount of available coverage to compensate the injured party.
