They love to have you shop in their stores, but sometimes store owners do not bother to remove dangerous objects or obstructions. You are entitled to safe conditions when you shop. If the store is on notice of a dangerous condition, then they additionally must give customers notice of the dangerous condition. Failure to follow these safety procedures can result in legal liability for the store. And serious injuries such as broken bones can and do occur from simply falling upon torn carpets, collections of rainwater, or other hard-to-see items in public aisles and walkways. Usually insurance companies attempt to prove that the injured party failed to see an “open and obvious” dangerous condition, or did not use ordinary care for his or her own safety.
